ABOUT
REJECTION, PREVENTION, ERADICATION,
ANIMAL DISEASE AND TREATMENT

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering:

• a. that livestock as a source of production to satisfy human needs for animal protein is one of production materials for Merrin gkatkan standard of living, prosperity and welfare of the nation and the State, its sustainability needs to be preserved and developed as well as possible;
• b. that the business development of animal maintenance and improvement needs to be protected from damages caused by a variety of animal diseases and the presence of disease can be transmitted from animals to humans;
• c. that on the basis of this, the business of rejection, prevention, eradication, and treatment of animal diseases need to be done carefully and appropriately regulated;

Referring to:

• 1. Article 5 paragraph (2) of the Constitution of 1945;
• 2. Decree of the People's Consultative Assembly No. IV/MPR/1973 on Outlines of State Policy;
• 3. Act No. 6/1967 regarding Basic Provisions for Animal Husbandry and Animal Health (State Gazette Year 1967 Number 10, Additional State Gazette Number 2824);
• 4. Law No. 5/1974 concerning the Principles of Governance in Regional (State Gazette Year 1974 Number 38, Additional State Gazette Number 3037);
• 5. The Government Regulation No. 17/1973 on the Preparation, Supply, Distribution, and Use of Vaccines, Sera, and diagnostic materials for Animals (State Gazette Year 1973 Number 23).

GOVERNMENT REGULATION OF REJECTION, PREVENTION, ERADICATION, AND TREATMENT OF ANIMAL DISEASES

CHAPTER I
GENERAL PROVISION

Article 1

For the purposes of this Government Regulation:

• 1. Government is the Government of the Republic of Indonesia.
• 2. Minister is the Minister responsible in the field of rejection, prevention, eradication and treatment of animal diseases;
• 3. Animal Disease rejection are:
• a. all measures for preventing entry of foreign animal diseases into the territory of the Republic of Indonesia;
• b. all actions to prevent animal diseases from an area / island that one into the area / island within the State Republic of Indonesia.
• 4. Animal Disease Prevention is any action to prevent the occurrence, outbreak and spread of animal diseases.
• 5. Animal Disease Eradication is any action to eliminate the incidence / occurrence, outbreak and spread of animal diseases.
• 6. Veterinary Medicine are all actions to implement recovery of infectious animal diseases and non-infectious.
• 7. Animal Port is a port, river, and air by the Minister designated as a place to insert or remove animals / livestock, raw materials of animal origin and the results of animal origin.
• 8. Animal quarantine is a place and / or action to isolate animals / livestock, raw materials of animal origin and the results of animal origin are affected or suspected animal diseases in order not contagious to animals / livestock healthy.
• 9. Animal disease surveillance is the act of inspection and surveillance conducted by Government agencies or regulatory experts appointed by the Minister, to obtain certainty whether one or more animals / livestock, raw materials and the results of animal origin of animal origin free of all animal diseases.
• 10. Original material of animals / livestock are materials derived from animal / livestock that can be processed further.
• 11. Results of Animal Origin Materials / Livestock is the material of animal origin / livestock are processed and used for human food, animal food preparation and raw materials for industrial and pharmaceutical.

CHAPTER II
GENERAL POLICY

Article 2

To ensure that the territory of the Republic of Indonesia is permanently free from animal diseases, the Government shall take measures which consist exclusion, prevention, eradication and treatment of animal diseases.

Article 3

In the performance of actions for the exclusion of animal diseases as referred to in Article 2, any animal/livestock, materials of animal origin, and products of material of animal origin imported into the territory of the Republic of Indonesia shall be accompanied by an Animal Health Certificate issued by the competent official in the country of origin.

Article 4

(1) Transfer of tasty animals, raw materials of animal origin and the results of animal origin from one Province to another Province in the Republic of Indonesia shall be accompanied by a Health Certificate issued by the competent authority for that, to meet the Animal Quarantine procedures.

(2) Every person shall prevent the emergence and spread of animal diseases that can be carried by hewan.ternak, materials of animal origin and the results of animal origin materials in transit or transportation between islands / territories in accordance with the provisions of legislation and regulations.

Article 5

(1) Every person must report any suspicion or existence of the case to the officer or relevant authority.

(2) The requirement to report as referred to in paragraph (1), is an obligation for pemilikhewan or breeder, civil service officials, officials of the village officials, and officials or experts who because of his job have anything to do with medication and treatment of animal diseases.

CHAPTER III
REGULATION AND ADMINISTRATIVE AUTHORITY

Article 6

(1) The performance of actions in relation to the exclusion, prevention, eradication, and treatment of animal diseases shall be regulated by the Minister.

(2) The making of such regulations as referred to in Paragraph (1) may be delegated to an official appointed by the Minister.

(3) The authority of carrying out the provision referred to in Paragraphs (1) and (2) may be delegated by the Minister to the Governor/Head of Regional Government.

(4) The Governor/Head of Regional Government in carrying out the authority referred to in Paragraph (2) shall be responsible to the Minister.

(5) The authority of carrying out the provision referred to in Paragraph (1) in respect of animal/livestock owned by the Armed Forces and Police Force of the Republic of Indonesia shall be transferred to the Minister of Defense and Security.

CHAPTER IV
SUPERVISION

Article 7

The Minister shall supervise the performance of actions in the exclusion, prevention, eradication and treatment of animal diseases as referred to in Article 6 to the best of his ability.

Article 8

(1) The Minister shall designate the kinds of animal diseases and free zones.

(2) The Minister shall designate animal ports after consultation with the Minister responsible for harbour matters.

Article 9

The Minister shall appoint qualified supervisors who shall participate in the actions of exclusion, prevention and treatment of animal diseases.

CHAPTER V
PENALTY PROVISION

Article 10

(1) Anyone who willfully acts in contravention of the provisions in Article 3, Article 4, and Article 5 shall be punishable by a maximum imprisonment of 2 (two) years.

(2) Anyone who on account of negligence acts in contravention of the provisions of Article 3, Article 4, and Article 5 shall be punishable by a maximum imprisonment of 6 (six) months or a maximum fine of Rp. 1.000.000,- (one million rupiahs).

(3) The punishable act referred to in Paragraphs (1) and (2) shall be an offense.

CHAPTER VI
TRANSITIONAL PROVISION

Article 11

(1) Subjects that have not yet been covered or have not been covered adequately in this Government Regulation shall be provided hereafter by the Minister or jointly with other Ministers concerned.

(2) Pending the issuance of the executive regulations under this Government Regulation, all existing regulations shall remain in force so long as they are not in contravention of the spirit of this Government Regulation.

CHAPTER VII
FINAL PROVISION

Article 12

This Government Regulation may be cited as Government Regulation Concerning Animal Diseases.

Article 13

This Government Regulation shall come into effect on the date of publication. In order that everybody may take cognizance of it, this Government Regulation shall be published in the Statute Book of the Republic of Indonesia.
